Mass. Hort. Soc'y. Report on their claim.

Mr C. P. Curtis presented the following Report. - "The Committee to whom was referred the subject of the "claim of the Massachusestts Horticultural Society to par"ticipate in the money received by the Proprietors of the "Cemetery of Mount Auburn for burial fees in the "Cemetery have had the subject under consideration and "respectfully " Report: - "That in their opinion the said claim is unadmissible"

"Stone estate", so called, and presented the following Vote

M.P. Brazee.

Voted. That the Treasurer and Secretary execute and deliver to M.P. Brazee or his assigns a deed of the land heretofore conveyed to him by ^a deed bearing date on the _____ day of _____, with a general warranty against all claims. and the vote so presented was thereupon accepted and passed by the Trustees.

Story J. bequest from

Mr B.R. Curtis presented the following Report. The Committee to whom was refered the subject of the bequest of the last Mr Justice Story, beg leave respectfully to report that the nature of the trusts upon which the bequest was made, in their opinion requires a separate account to be kept of the income and expenditures of this fund, but pursuant to a regulation made by the Trustees on the . there can be no separate investment of it; that regulation was as follows. (See vote on page 95.) We do not perceive any good reason why it should be departed from it this instance. The donor was himself one of the persons by whom the regulation was made, and having made a bequest which comes within its terms & spirit must be taken to have made the bequest subject to the regulation. At the same time we should think it proper to give notice to the Executors of Mr Justice Story of the regulation and how the income of the fund will be ascertained. We have subjoined certain votes which we think should be passed.

DEED. Proprietors. &c. to M.P. Brasee. v.p118

Know all Men by these Presents -- That the proprietors of the Cemetery of Mount Auburn, a corporation established by law in the county of Middlesex in the Commonwealth of Massachusetts. In Consideration of five hundred dollars to them paid by Morton P. Brasee of Cambridge in said Middlesex. Housewright the receipt whereof is hereby acknowledged, do hereby remise, release and forever Quit=claim into the said Morton P. Brasee his heirs and assigned all our right title, and interest and estate in and to a certain parcel of land situated in the southeasterly part of Watertown in said Middlesex with a dwelling house, and other buildings thereon, containing by survey nineteen acres and thirty five rods be the same more or less bounded southwesterly by Charles River about six hundred and seventeen feet. Westerly by land of the heirs of Nathaniel Stone from said river to a road three hundred and seventy six feet Northerly by said road about four hundred and fifty feet to a corner near the house, then Westerly again by a way or continuation of said road along the easterly side of Mount Auburn Cemetery, nine hundred and sixty six feet; then Northerly by the heirs of Cornelius Stone two hundred and thirteen feet in a straight line Easterly also by land of said heirs in nearly a straight line nine hundred and fifty feet to the edge of the salt marsh at a post, then

South Easterly by a slightly bending line at the junction of the upland and the marsh and by said heirs of Cornelius Stone about six hundred and seventy one feet to a stake; then Easterly by said heirs land and a straight line across said marsh to a stake at the river one hundred and four feet; said parcel of land being that parcel of the estate of the late Moses Stone deceased lying southeast of the road and way afore said which was set off to his widow for her dower and occupied as such by her untill her death. Together with a right of way in over and upon a strip of land belonging to the said proprietors of the Cemetery of Mount Auburn and extending from the main road (which [lies?] on front of the Cemetery) to Watertown to the back or southerly land of said Cemetery bounding on the easterly side in part on land of one Coolidge, and in part on land herein released to said Brasee, and reckoning from said land of said Coolidge and said Brasee uniformly two rods in width and no more --

To have and to hold the above released premises to the said Morton P. Brasee and his heirs and assigns to their use and behoof forever. And their said Proprietors of the Cemetery of Mount Auburn do covenant with the said Morton P. Brasee his heirs and assigns, that the premises on

free from all incumbrances made or suffered by them and that they will warrent and defend the same to the said Morton P. Brasee his heirs and assigns forever against the lawful claims and demands of all persons claiming by through or under them but against non other.

In witness whereof, the said proprietors of the cemetery of Mount Auburn have caused these present to be signed by a committee of the Trustees consisting of Charles P. Curtis and by the Secretary of the Corporation Henry M. Parker and also the common seal of the said corporation to be hereunto affixed ^on this signed sealed & delivered in the presense of, B.R.
