Towns of Cambridge & Watertown, in the County of Middlesex, heretofore known as the Cemetery & Experimental Garden at Mount Auburn, together with all Lands appurtenant to the same in which the Grantors have any interest, property or estate; - The said premises being estimated to contain in the whole about one hundred & ten acres, & for a more particular description of which reference is made to the Deeds of Rhoda Crafts, George W. Brimmer, Joel Stone, David Stone, David Stone Guardian Columbus J. Stone, Melinda Stone, William M. Poweroy & wife, Ann Cutter, generally to the Massachusetts Horticultural Society, recorded in the Registry of Deed for the County of Middlesex.

To have & to hold the afore granted Premises unto the Proprietors of the Cemetery of Mount Auburn & to their successors & assigned forever, upon the trusts, & for the uses & purposes mentioned & expressed in the Act of the Legislature entitled, "An Act to incorporate the Proprietors of the Cemetery of Mount Auburn." And it is hereby understood & agreed between the par ties that conveyance is made expressly upon the following fundamental stipulations, which are to be mutually obligatory & binding upon the parties, as contained in the tenth section of the said Act incorporating the said Proprietors of the Cemetery of Mount Auburn. First, that the present Proprietors of Lots in the said Cemetery, who shall become members of the Corporation created by the said act, shall thenceforth cease to be members of the Horticultural Society aforesaid,

Treas Report.

the past year. By this it appears that the sum of $2985 Dollars has been inoested [invested] for account of the Proprietors $884.06 paid over to the Treasurer of the Mass. Hor. Society & $1253.59 remains in the Treasury.

The whole investments are as follows vis.

Mr. Russell, the Superintendant of the Cemetery reports, that during the year ending the 31st ult. 43 tormbs have been built, 21 monuments erected, 45 Lots turfed & otherwise improved & 191 interments made - that the whole number of tombs is 122, of monuments 109, of interments 456 & of interments in the public Lot 14. All which is submitted

The Trial Balance of his Books annexed hereto, shows an addition to the available funds of $4265.79 during the past year, the total amt being $16,246.58. of which the sum of $14,420. is invested. The last assessment ($800) on 4 Shares in the Stark Mills will soon be called for. Whether the Shares in Eastern Rail Road will be assessed beyond 7.5 dollars each, is uncertain The number of lots sold during the year is 57, and the whole number sold is Six hundred & ninety. The superintendent reports the Interments & Improve ments to be as follows, to wit;
