Towns of Cambridge & Watertown, in the County of Middlesex, heretofore known as the Cemetery & Experimental Garden at Mount Auburn, together with all Lands appurtenant to the same in which the Grantors have any interest, property or estate; - The said premises being estimated to contain in the whole about one hundred & ten acres, & for a more particular description of which reference is made to the Deeds of Rhoda Crafts, George W. Brimmer, Joel Stone, David Stone, David Stone Guardian Columbus J. Stone, Melinda Stone, William M. Poweroy & wife, Ann Cutter, generally to the Massachusetts Horticultural Society, recorded in the Registry of Deed for the County of Middlesex.

To have & to hold the afore granted Premises unto the Proprietors of the Cemetery of Mount Auburn & to their successors & assigned forever, upon the trusts, & for the uses & purposes mentioned & expressed in the Act of the Legislature entitled, "An Act to incorporate the Proprietors of the Cemetery of Mount Auburn." And it is hereby understood & agreed between the par ties that conveyance is made expressly upon the following fundamental stipulations, which are to be mutually obligatory & binding upon the parties, as contained in the tenth section of the said Act incorporating the said Proprietors of the Cemetery of Mount Auburn. First, that the present Proprietors of Lots in the said Cemetery, who shall become members of the Corporation created by the said act, shall thenceforth cease to be members of the Horticultural Society aforesaid,

Title of George W. Brimmer to the Sweet Auburn Estate.

Moses Stone owned the estate more than twenty years before his death prior to 1803.

His Estate was settled by Aaron Learned as Admr. Admn Bond dated

Moses Stone's farm at Sweet Auburn was divided as follows: 3 lots were set off to the Widow as dower, and the residue assigned to two of his sons, Moses & Cornelius, they paying the other heirs (9 in all) $517.33c each. - Receipts of the heirs, on file in the Probate office, Middlesex.

Moses Stone to Cornelius Stone.

A quitclaim of all his "right, interest and estate" in the farm at Sweet Auburn - "and it is the intention to release the 2/3 ds of said farm, assigned to me and said Cornelius by the Judge of Probate."

Cornelius Stone to Jane, Wife of Asaph Stone. Conveys 150 acres, bounded Sy & Ey on Charles River, then on a boundary line between Cambridge & Watertown, Ny on Elb. Gerry, Thos Lee & Jonas Wyeth, Wy on David Stone, Joshua Coolidge, and Nathl Stone (excepting the dower assigned to the widow of the late Moses Stone). being all the estate assigned to Moses & Cornelius Stone.

Cornelius Stone died in 18 The Certificate of the Reg. of Prob. for Middlesex is as follows.

"Middlesex. ss. In Probate Office. ."

It appears by the Records & files in this office that on the . Nath. Stone of Watertown, in said County was duly appointed Administrator of the Goods & Estate of Cornelius Stone late of the same Watertown, Yeoman, deceased, and gave a Bond acceptable to the Judge for said trust. - On the following returned Inventory & made oath to the same; at the same Court petitions for allowance to the Widow, & obtained the same, being $500. - On made affidavit of notice on settled acct. with Judge of Prob. all persons interested having certified their assent. At the same Court obtained license to sell so much of the Real Estate as would raise the sum of $3349.39ct, besides the sum of $30 - for incidental charges - filed bond and made oath."

Gray, and said Lee again, and the town line between Watertown & Cambridge to a corner, then Sy & Ey by land set off to Mrs. A. Pomroy (the widow of Moses Stone) as dower, then Sy. & Wy. by other land of said Cornelius to the first mentioned bound, or however otherwise bounded or reputed to be bounded; - Consideration $263

A conveyance of part of the above lot, bounded as follows, Beginning at the South East corner at a private way and running NWy 42 rods 14 links by land set off to Mrs. A. Pomroy, thence N.Ey. 23 rods, 11 links by said land to land of Thos. Lee, thence N.Wy. by said Lee, 30 rods, 6 links, then SWy by Wm. Gray 15 rods 21 links, then Wy. by said Gray 11 rods, 21 links, & continuing Wy. by said Lee, 11 rods, 4 links, & stile Wy by land of Jonas Wyeth 17 rods - then Sy by land of said David Stone, 99 rods, 18 links, then Ey as the fence now stands, 53 rods, 7 links by land of the heirs of Corns. Stone: then NEy by the private way aforesaid 38 rods, 23 links to the first mentioned bounds. the said lot containing 34 ac. 65 poles.

Endorsed on the back of the above deed is a release of all right, title, &c. (of dower) by Melinda Stone, Widow of Cornelius Stone, - but which is not acknowledged. - - This deed has since been acknowledged & recorded anew.

Know all men by these presents That Asaph Stone of the City of Philadelphia in the state of Pennsylvania Merchant and Jane his wife for and in consideration of the sum of Seven thousand Dollars lawful money to them in hand paid by Cornelius Stone of Watertown in the County of Middlesex and Commonwealth of Massachuesetts Yeoman at the time of the execution hereof the receipt whereof is hereby acknowledged Have and hereby Do Give, Grant, bargain sell and Convey unto the said Cornelius Stone his Heirs and assigns forever a Certain Farm situate in said Watertown with a dwelling house, barn and out buildings thereon Standing Containing in the whole One hundred and fifty Acres and is bounded and described as follows Viz Southerly and Easterly by Charles River which is there the Boundary line between said Watertown and Cambridge, Northerly on Land now or late of Elbridge Gerry, of Thomas Lee and Jonas Wyeth and Westerly by Land of David Stone, Joshua Coolidge and Nathaniel Stone except thereout the Widow of Moses Stone' deceased's dower as the same was set off to her by Commissioners appointed by the Honble Judge of Probate for the County of Middlesex (Being the same premises which the said Cornelius Stone and Melinda his Wife by their Deed Poll dated the Entered in the Registry of Deeds for the said County of Middlesex in Book 210 page 169 did grant and Convey unto the said Jane Stone in fee Simple) Together with the Rights, Members and appurtenances thereunto belonging To have and to hold the said premises above granted unto the said Cornelius Stone his Heirs and assigns to his and their own proper use and Behoof forever And the said Asaph Stone for himself and for the said Jane his Wife his and her respective Heirs Executors and administrators doth hereby Covenant promise and agree to and with the said Cornelius Stone his Heirs and Assigns That he the said Asaph Stone and Jane his Wife and their Heirs respectively all and singular the Premises hereby granted and Conveyed or mentioned and intended so to be with the appurtenances unto the said Cornelius Stone his Heirs and Assigns against them the said Asaph Stone and Jane his Wife and their Heirs respectively
