The Subscribers agree to pay the sums annexed to their names respectively, for the purpose of procuring a marble statue of the late Joseph Story to be placed in Mount Auburn Chapel, under the direction of a committee to be chosen by the subscribers, at a meeting to be called by the Trustees of Mount Auburn Cemetery, when they shall deem the sum subscribed to be sufficient for the purpose -.

The undersigned, subscribers now surviving, to the fund for the purchase of a Statue of the late Mr Justice Story, respectfully represent to the Trustees of the Cemetery of Mount Auburn, that the fund subscribed by them were given on the condition that the Statue should be placed in the Chapel of the Cemetery: -- and inasmuch as the said statue is completed, the under signed request that it may be removed to its place of destination, as early as convenient. Ten years have elapsed since the subscriptions were paid into the hands of the Treasurer of Mount Auburn, and about one third of the contributors have departed this life, without witnessing the accomplishment of the object for which their contributions were made by them and accepted by the Trustees of the Cemetery -- April 1856

The undersigned subscribers to the Statue of Joseph Story, in the Chapel at Mount Auburn, hereby release to "the Proprietors of the Cemetery of Mount Auburn" all and any balance of money which may have remained unexpended after the completion and erection of the said Statue - on the condition that the Trustees of said Corporation shall devote and apply the said balance to the preservation and perpetual repair of the burial lot which contains the mortal remains of the said Joseph Story, upon the same terms of trust upon which the perpetual repair of all lots in said Cemetary is or may be guarantied. -
