Monument to Mr Pitts

Voted. That the choice money for the lot purchased by Mr Francis on behalf of the subscribers for a burial lot and monument to _____ Pitts (who perished in ____ last on board the steamer Atlantic) be remitted.

Perpetual Repair of Lots in LAWRENCE Enclosure.

The Secretary read a communication from Amos Lawrence and brothers asking how much they must pay to have the Lawrence Enclosure kept in perfect repair through all time, and thereupon, after a general discussion of the subject, Voted. That the Secretary be instructed to inform the Messrs Lawrence that this Corporation will assume the care of their enclosure as a charge in perpetuity, according to the form adopted by the Trustees . for the sum of two thousand dollars.

Perpetual Repair of Lot 233

The Secretary having made a statement in relation to the lot numbered 233. The following vote was adopted. Whereas Mrs Elizabeth Williams the present proprietor of the lot in the Cemetery of Mount Auburn numbered two hundred and thirty three, is desirous of making some provision for the proper maintenance care and repair of the same in its present condition through all

time and has expressed an intention of devising the same to this Corporation to be by them held and maintained in good order and repair as aforesaid . _ therefore --

Lot 233.

Voted that upon receiving notice of a valid devise of said ot numbered two hundred and thirty three by virtue of which the title to the same shall revest in this Corporation, and upon the receipt at the same time and under the last will and testament of the said Mistress Elizabeth Williams of the sum of two thousand dollars, this Corporation will accept the said devise and bequest and from and after that time keep the same in perpetual repair in its present condition forever

Trustee chosen.

The Trustees then proceeded to the election of one person by ballot to fill the vacancy in the board of trustees caused by the death of the Hon. Martin Brimmer. The ballots having been collected counted and examined were found to be all for the Honorable Theodore Lyman, and he was accordingly announced to be unanimously elected.

the matter. The subject was recommitted to Messrs Gould and Read.

Iron Safe. for use of the Secretary _

The Secretary reported the purchase of a large safe by a committee of one, J.J. Dixwell, for the preservation of his records. It is in his office, at 46 Washington St, The safe was stated to be one of Messrs Edwards & Holman's make - styled Improved Salamander Safe. Mr Curtis suggested doubts of its sufficiency to withstand fire, and the subject was recommitted to the President and Secretary for examination on this front.

S. Newall's Claim.

A letter from Mr Samuel Newell was read, asking the gift of a lot in the Cemetery, in consideration of his long continued services in making up the accounts at the Cemetery. Doubts were expressed, and the whole matter was referred to a committee consisting of Messrs Crockett & Little with full powers.

E.W. Williams Legacy. Petition from her Executor.

A petition from D. Watson Jr. Executor of Elizabeth Watson Williams' last will, was presented. It was accompanied by affidavits and other papers showing that the testatrix had determined to reduce a legacy in her will, to this Corporation from $2000 to $1000. to secure the perpetual repair of her lot number 1697, on Spruce Avenue. The sum of $2000. had formerly been fixed by the trustees, at her own request, for another lot, no. 233 -- on Walnut Avenue. (see p.160.1 of these records,) and she had transferred the be-

Trustees. .

Pursuant to notices issued in the usual manner the regular monthly meeting of the Trustees was held at Mr C.P. Curtis office, on Present Messrs Bigelow, Crockett, Curtis, Parker and Read.

The record of the last meeting was read & approved.

E.W. Williams Legacy.

The committee on the petition of D. Watson Jr. Executor of the will of the late Elizabeth W. Williams (see p.225). reported the following preamble and votes as proper to be adopted under the circumstances.

Whereas it has been made to appear to this Board that Mrs Elizabeth W Williams at the time of her death was about to reduce a legacy in her will to this Corporation, from two thousand to one thousand dollars, wishing this Corportion in consideration of the latter sum to accept a devise of her lot, number 1697 on Spruce Avenue, and contract to keep the same in perpetual repair in its present condition as mentioned in her will: and whereas in the opinion of this board the sum of one thousand dollars is amply sufficient for the purposes there named.

Voted. That upon receiving notice of a valid devise of lot numbered 1697, by which the title to the same shall revest in this corporation, and upon the receipt at the same time of the sum of one thousand dol lars from the Executor of Mistress Elizabeth W. Williams last will and testament this Corporation will accept in said devise and the bequest of one thousand dollars and from and after that time keep the said lot in good repair in its present condition forever: provided

always, that the Executor shall at the same time release any claim which he may have in any way upon this corporation by virtue of a vote passed by the Trustees (see p. 160-161) with regard to lot numbered 233, which Mrs Williams, his testatrix, then owned.

Voted. That upon receiving such notice, and release together with the sum of one thousand dollars the Treasurer and Secretary be authorized, to execute a release in the name and behalf of this Corporation to the said Executor in full of any further claim upon the estate of the same testatrix

On motion of Mr Read, the report was accepted and the votes as reported unanimously adopted by the Trustees.

Judge Curtis'- Reply from -

The Secretary read a letter from Judge Curtis in reply to the vote passed by the Proprietors on the occasion of his resignation, which reply was ordered to be put in file.

Stained Window of the Chapel. injuries to.

The President stated that the round pane in the head of the principal window of the Chapel on the Northern end, or Chancel window, had been destroyed in a recent storm, and it was unanimous ly Voted, that the President be a committee with full powers, to cause the same to be replaced.

Trustee Process. in the matter of Bryant & Blaisdell's Claim.

The Secretary gave notice of a Trustee process, served on the Corporation, thereupon it was Voted. That this Corporation having been summoned as a trustee in a suit by the Boston Gas Light Company vs. Bryant and Blaisdell, the Secretary be appointed the Attorney of this Corporation to appear and file an answer in its behalf.
