Towns of Cambridge & Watertown, in the County of Middlesex, heretofore known as the Cemetery & Experimental Garden at Mount Auburn, together with all Lands appurtenant to the same in which the Grantors have any interest, property or estate; - The said premises being estimated to contain in the whole about one hundred & ten acres, & for a more particular description of which reference is made to the Deeds of Rhoda Crafts, George W. Brimmer, Joel Stone, David Stone, David Stone Guardian Columbus J. Stone, Melinda Stone, William M. Poweroy & wife, Ann Cutter, generally to the Massachusetts Horticultural Society, recorded in the Registry of Deed for the County of Middlesex.

To have & to hold the afore granted Premises unto the Proprietors of the Cemetery of Mount Auburn & to their successors & assigned forever, upon the trusts, & for the uses & purposes mentioned & expressed in the Act of the Legislature entitled, "An Act to incorporate the Proprietors of the Cemetery of Mount Auburn." And it is hereby understood & agreed between the par ties that conveyance is made expressly upon the following fundamental stipulations, which are to be mutually obligatory & binding upon the parties, as contained in the tenth section of the said Act incorporating the said Proprietors of the Cemetery of Mount Auburn. First, that the present Proprietors of Lots in the said Cemetery, who shall become members of the Corporation created by the said act, shall thenceforth cease to be members of the Horticultural Society aforesaid,

Know all men by these Presents, that the Proprietors of the Cemetery of Mount Auburn, a Corporation established by law, in consideration of the payment of fifteen thousand six hundred and twenty dollars by John B. Dana of Cambridge in the County of Middlesex and Commonwealth of Massachusetts, the receipt of which ^ Said Corporation doth is hereby acknowledge &c hereby give grant bargain sell and convey unto the said Dana a tract of land with the buildings thereon lying in Watertown in said County of Middlesex, and containing sixteen acres one rood and thirteen and eight tenths of a Rod, and bounded and measuring as follows, viz: beginning at the most South Westerly corner thereof on land of David Stone, and on a street ^said to be called Grove Street, and running in an Easterly direction and bounding on said street seven hundred and thirty one feet to the point marked "d" on the Plan hereinafter named, being the corner of other land of said Corporation then turning and running in a Northerly direction, bounding on said Corporation's other land seven hundred and thirty and a half feet to the point marked "c" on said Plan; then turning and running Easterly. still bounding on other land of said Corporation, three hundred and eighty eight feet to said street, there sometimes known as "Coolidge Avenue" at the point marked "f" on said Plan, then turning and running in a North Easterly direction and bounding on said street one hundred and two feet to the corner of still another tract of land belonging to said Corporation at the point - marked "g" on said plan; then turning and running in a Westerly direction, and bounding on the last named tract of land of said Corporation one thousand three hundred and eighty nine feet and nine inches to land of David Stone at the point marked "a" on said plan; then turning and running in a Southerly direction and bounding in said land of David Stone, eight hundred and fifty three feet to said street, at the point marked "e" on said Plan, which is the point begun at

[Supts Departt Mode of receiving & disbursing moneys _] and by Treasr Bills for labor to be approved by Propr or Comee on Lots -

amount shall be paid by him; and that all bills of like amount shall be paid by him; and that all bills except those for labor shall be approved either by the proprietor for whom the work is done, or by the Committee on Lots; provided that nothing herein contained shall be understood as conflicting with the provisions of any existing by-law."

No paid Servant of Corporation to be interested in any work or material in and for Cemetery –

It was further voted, upon motion by Mr Curtis, and in accordance with the recommendation of the said report,

"That neither the Superintendent, Gate Keeper, nor any other paid servant of the Corporation, shall have any interest whatever in any work at or materials furnished for the Cemetery."

The Committee on Grounds to which was referred, at the last meeting, the subject of puchasing a piece of land westerly of and adjoining the Stone farm, reported through Dr Bigelow, chairman,

That the Committee had examined the premises, and found that the purchase of a piece of land from Mr Stone would not tend to straighten the westerly line, as a piece of meadow or pond makes a sharp angle with the Stone land, and would therefore separate this from direct connection with the present cemetery. They therefore reported that it was inexpedient to purchase the same. ~

The report was adopted. _

To all Persons to whom these Presents shall come

Greeting

Know ye that the Massachusetts Horticultural Society in consideration of Ten Dollars paid to them by the Proprietors of the Cemetery of Mount Auburn, the receipt of which is hereby acknowledged, and for [?] other good and valuable considerations, do hereby grant, sell and convey unto the said Proprietors, their Successors and Assigns, all their Property and Estate in and to the Lands in the Towns of Cambridge and Watertown, in the county of Middlesex, heretofore known as the Cemetery and Experimental Garden at Mount Auburn, together with all Lands appurtenant to the same in which the Grantors have any interest, property or estate;- the said Premises being estimated to contain in the whole about one hundred and ten Acres, and for a more particular description of which reference is made to the Deeds of Rhoda Crafts, George W. Brimmer, Joel Stone, David Stone, David Stone Guardian, Columbus J. Stone, Melinda Stone, William M. Pomroy and Wife, Ann Cutler Severally to the Massachusetts Horticultural Society, recorded in the Registry of Deeds for the county of Middlesex.

To have and to hold the aforegranted Premises unto the Proprietors of the Cemetery of Mount Auburn, and to their Successors and assigns forever upon the Trusts and for the uses and Purposes mentioned and expressed in the Act of the Legislature, entitled "An Act to incorporate the Proprietors of the Cemetery of Mount Auburn"

And it is hereby understood and agreed between the parties that this conveyance is made expressly upon the following fundamental stipulations, which are to be mutually obligatory & said Act incorporating the said Proprietors of the Cemetery of Mount Auburn; First, that the present Proprietors of Lots in the said Cemetery, who shall become Members of the Corporation created by the said Act, shall thenceforth cease to be members of the Horticultural Society aforesaid, so far as their membership depends on their being proprietors of Lots in the said Cemetery; - Secondly, that the Sales of the Cemetery Lots shall continue to be
