. Perpetual Repair of Lots 358 & 359 _

The Secretary reported that the Committee on Lots had contracted with Wm W. Stone proprietor of lot no. 358 and Mrs Elizabeth Stone, widow of Henry B. Stone, late proprietor of lot no. 359, (said lots being contiguous with tombs thereon,) for the perpetual care of the same, on payment of three hundred and fifty dollars for each lot. _

Voted that said contract be ratified _

The regular monthly meeting of the Trustees was held on Tuesday, , at 10 o'clock a.m.

There were present the President and Messrs Adams, Bowditch, Cheever, Little and Livermore.

The record of the last meeting was read. _

Comee suit of Granite Railway Company instructed to settle _

A letter from Henry W. Paine Esqr addressed to "Dr Jacob Bigelow" upon the subject of the suit of the Granite Railway Company against this Corporation was read _

Upon which it was

Trustees. .

all pending Communications from the Superintendent to the Committee on Grounds be re=considered.

Computations as to rel. quantity of saleable & unsaleable lands referred to Comm. on Grounds.

On motion of the same gentlemen it was

Voted, – that the Communication of the Superintendent dated , in regard to the relative quantity of saleable and unsaleable land in the Cemetery, addressed to Hon. Otis Norcross and by him recommended to the attention of the Board of Trustees, be referred to the Committee on Grounds.

Recommendations as to Increase of Permanent Fund referred to Comm. on Lots.

And that the Communication of the Superintendent dated , addresssed to the Board of Trustees, recommending that any surplus remaining at the end of each year from the amount received from the care of lots should be added to the "Permanent Fund" for the care of the Cemetery be referred to the Committee on Lots.

Eligibility to office of Reps of Lots, –

The President submitted to the Board a legal opinion obtained by Mr Rand from Henry W. Paine Esq., respecting the eligibility to office of representatives of Lots. And it was

Legal opinion of H. W. Paine concerning, ordered on file, & Bill approved.

Voted, – that Mr Paine's written opinion be placed upon file.

Voted, – that Mr Paine's Bill for Professional services for $20. – be approved and paid.

Contracts for Perp. Rep. with Guaranty of Lots 2000 2629 & 3724

The Secretary having stated that the Committee on Lots had recommended the Trustees to guarrantee the perpetual repair of Lot No 2000 on Pine Avenue, belonging to the late Abraham Hilliard, deceased, for Four hundred and twenty=eight 80/100 dollars; of Lot No 2629 on Arethusa Path, belonging to the late Hon. Richard Fletcher at his decease devised by him to the Corporation in trust, and conveyed by his Executor in pursuance of said devise in consideration of the contract aforesaid ^for six hundred dollars; –;

Trustees,

A monthly meeting of the Trustees was held on Wednesday, at four o'clock P.M.

Present, Messrs. J. T. Bradlee, Brewer, Browne, Choate, Lawrence, Little, Perkins, Pickering, Snow and Spelman.

The record of the last meeting was read and approved.

Lot #3549 Re-conveyance to Corpn authorized, for purpose of issuing new deed.

A verbal report was made by the chairman of the Committee on Lots, upon the subject of the request of the owner of Lot #3549 for a release by the corporation of the restrictions imposed at the time of the grant; stating that the Committee entertained doubts as to the power of the Board of Trustees to release or impose conditions by a vote; and recommending that the Secretary be authorized to receive from the present holder of the title a deed of re-conveyance to the corporation, for the purpose of issuing to him a new deed of the same premises in its present form.

Voted, – that the report of the committee be accepted, and the recommendations thereof adopted.

Monthly Schedule of Bills referred to Prest, also Bill of H. W. Paine approved.

The usual monthly file of bills, with accompanying schedule, having been submitted to the Board, it was
