Dear Sir,

In sending the accompanying notice to some two or three hundred of our proprietors whose lots are therein described, your lot was casually overlooked - as it did not get on to my notes. But not only is Lot 323 deficient of proper bounds if it has any, but lot 1443 - that of the late S. R. Putnam - is not located at all on our plans, although I have seen it on a lithograph plan directly behind lot 323. The only plan however which we rely on does not contain it. The deed describes its situation thus - "adjoining lot 323 on the southerly and westerly sides of the same."

It is therefore entirely evident that it must be laid out anew if it ever has been at all, [or where?] find a proof and this should be done previous to any other work that may be desired.

I made a verbal statement of this a few days since to your brother, James R., in consequence of receiving a written request from him that O'Brien should do some work on the lot: but he asked that I should put the statement in writing. While conversing with him, it occurred to me, and I mentioned to him, that you were the representative of the lot - recently appointed upon the application, of the several heirs. I left him without any definite understanding of whether this matter would receive his attention, and therefore communicate the facts to you, as perhaps I ought to have done in the first instance, but as a matter of courtesy called on him.

The laying out of lots and putting down their bounds is the proper duty of the Corporation and cannot be delegated to others; and should precede any other work to be done on a lot.-

If the Putnam lot can be laid out in a regular manner on one of the other side of lot 323, four 8 inch granite posts will answer as the bounds for both lots- costing, with their setting, $8.-

I will issue a permit to O'Brien at any time for the work you wish, after we can determine the location.

By the way, please specify the "other work", which you add to the building of "catacombs." The reason will appear in the copy of the rules enclosed rule.-

Dear Sir, I send the petition which I drew up for the signatures of your brothers and sisters in Acton. I supposed you would call for it before leaving town.

When you return the petition, please send me $2 for recording deed & going to Cambridge & elsewhere in searching for it. I think you will agree that I fully earned the money.

I shall record the deed as it is, and if we can even catch Mr. Thos. J. Drew we will make him cure it, if possible- but a new deed cannot be given now because Mrs Drew is dead, and it's rule of the Corporation do not allow any other person than the Corporation to make a deed to several heirs.

Mrs.Mrs H.A.S. Channing

Dear Madam,

I sent the bill of $4.00 for care of lot 1145, for year 1868, some time since to C.C. Smith Treasr of Dr Gannett's Society, & he refuses to pay the same, on the ground that the Society has nothing to do with this lot. Mr B.F. White, who has always had direction in the matter of care of late Dr Wm Ellery Channing's lot, has for several years, paid a bill to O'Brien -- our Irish gardener in Cambridge -- of $15.00. I think this bill covers the lot of Geo. G. Channing no 677 & R. Gibbs Channing 678 both containing 900 square feet --

Your lot (1145) contains 250 feet and, what makes the case a disagreeable one, is in one enclosure with the other two: for which reason the lots should be [?] fer by only one gardener --

As Mr White appears to be partial to O'Brien we do not care to disturb his wishes that O'B should take care of the W. E. C. lot. As to your own we can take charge of it if you wish: but they would appear to better advantage if taken care of together.

The bill of $4. for [1868?] is therefor now returned to you for payment. If you desire us to continue care ^for [1869?] you should give a written order to that effect.

from the proprietors of Lots Nos 111 and 4240, deeds of re-conveyance of said Lots to the corporation, for the purpose of issuing new deeds of said premises in such manner and form as the Committee on Lots may approve.

Lot #3549 Release of conditions as to curbing requested. Subject re-committed to Com. on Lots to consider & report.

A further communication was also made by Mr Perkins, in behalf of said Committee, to the effect that "Lot #3549 on Garden Avenue, now owned by O'Brien has been sold by him to a Mr Blodgett. The original deed contains a condition that the Lot shall be curbed. The purchaser desired a release from the condition, and the Committee ask that the Secretary be authorized to accept a conveyance for the purpose of issuing a new deed in the present form."

Mr Choate having suggested that the object sought by the Committee might be allowed by a simple release by the corporation of the condition imposed at the time of the grant, it was on motion of Mr Bradlee,

Voted, – that the subject be re-committed to the Committee on Lots to consider and report.

Statements of Treasr for 3 qrs. of the year 1874 approved
