Charles Medforth, William Hodgson,
Thos Lindley - and - Edward Wilson, - as directed
when they pleaded guilty of the offence with which
they were charged, _ expressed great contrition, _ and
threw themselves on the mercy of the Magistrates who
- in consideration of their having given up the mater-
-ials and the Bricks which they had taken from the
"Capital," _ immediately on my sending to them,
and all being very poor men, _ fined Coleman, in
the penalty of £1_0_0_ and 8s/_ costs, and the other
five_ each_ 10s/_ and 8s/_ costs, _ and gave a fortnight
for payment, _ On dismissing the men the Magis-
-trates severely admonished them , - explaining to
them that - under the 478th Sect of the MS Act
1854 they had power to fine each of them any
sum not exceeding £50_0_0. - The materials
which had been wrongfully removed by the men
sold for £18_0_0 odd only, - and the present being
the first offence under the existing Law with which
the men had been charged, - the Magistrates ex-
-pressed a hope that by asserting its authority in
the in the lenient manner they have done, - it
will have the desired effect of preventing future
obedience to the Officers in the respective districts
In my letter of the 5th Ulto - I informed the
Secretary of the Marine Department Board of
Trade, _ that I had directed the Coast Guard Officer
to deliver the property to Mr Clarkson, Agent for the
Wakefield Marine Insurance {Company} Society
in which the Vessel was insured, _ Instead of which
I should have said, that Mr John Scott of, Sandmill
near Wakefield, the Owner of 32/84ths, _ and who was
authorized by his neighbour Mr Jas Craven, the owner
of the other 32/84th parts had placed the wreck
under the management of Mr Clarkson.
The wreck happened at about 4 A.M on
the 26 of Octbr last, _ and Mr Scott, _ who had been
