This Indenture made and entered into this 12th day of February 1844 by and between Ann E. Boswell of the first part, John N. Peters of the second part and John M Bates of the third part. [?] that whereas it is Contemplated and intended that a marriage Shall shortly be had and solemnized between the said Ann E. Boswell and the said John M Bates and the said Ann E. Boswell deeming it just proper and provident out of her own estate which is now a small one to make some provision for her future maintenance and support and for the support maintenance and Education of the issue of the said Marriage. Should there be any and to guard as far as she can against the reverses and vicissitudes of future and especially aginst the embarraasments and liabilities of the said John M Bates who has been unfortunate in trade. Now in Consideration of the [?] and for the further Consideration of the sum of five dollars in hand paid by the said John N. Peters before the sealing and delivery of these presents that receipt of which is hereby acknowledged. She the said Ann E. Boswell hath granted bargained and sold and by these presents doth give grant bargain sell [?]Convey and Confirm unto the said John N. Peters the following property real and personal to wit. A tract or parcel of land lying and situated in the County of Mecklenburg adjoining the lands of Wm. R. Tisdale Tho. A Recks and others containing one hundred and niety five acres be the same more on [?] it bring the land lately purchased by the said Ann E. Boswell of Wm. T.J. Finch, six slaves Charles Osborne, Henry, Isaac, Milly, Mahaley, one riding Carriage and [?] and a pair of carriage horses, all the cattle, sheep and hogs, all the household kitchen furniture plantation tools and utencils, one, two horse Waggon and gear, all the crop of Corn, Tobacco, wheat, oats and [?] and all moneys, bonds, goods, and effects now held as owned by her the said Ann E. Boswell, and all the rights and interst which she has or may have as one of the heirs or devisees of the late Thos Taylor her father in [?] the estate held by the WIdow of the said Thos. Taylor [?] for life to him the said John N. Peters his heirs and asigns forever. TO have and to hold the said tract or parcel of land with all the rights priviledges and [?] to the same belonging or in anywise appertaining with the slaves
