1868-02-11 Trustee Special Committee Report on Miles, Lot 236, 2021.004.043

The Committee to whom was referred the Petition of Harriet M. Miles, [praying?] that Henry A. Miles may be designated to represent Lot No 236 late of Henry P. Miles, deceased, beg leave to report. By the Act of Incorporation Section 8^a it is provided that "upon the death of any Proprietor of any Lot in the Cemetery containing not less than 300 Square feet, the devisee of such lot or the heir at law as the case may be, shall be entitled to all the privileges of membership as aforesaid, and if there by more than one devisee or heir at law of such lot, the Board of Trustees for the time being shall designate which of the said devisees or heirs at law shall represent the said lot and vote in the Meetings of the Corporation."

By this act of the Legislature incorporating the Proprietors & defining the rights & duties of the Trustees the Trustees are authorized to designate one from among several devisees or heirs at law to represent a lot but they are not authorized to appoint any other person Even though requested so to do by those Entitled to ownership of the lot.

From the petition of Mrs Miles it appears that

Henry A. Miles whose appointment is requested is neither an heir at law or devisee of the Lot in question [and your?] Committee was therefore of [opinion?] that the Trustees are not authorized to designate or appoint him to represent the same

They therefore recommend that the petition be not granted
