Scarborough. One payable to said Jacob McElroy and the
other to plaintiffs for the sum of Seventy three 50/100 Dollars
each. Plaintiffs then introduced [parol?] evidence tending to
prove that said Scarborogh was in possession of said lands
when the same were levied on and sold by the sheriff, as
aforesaid and that he was in the undisturbed possession
of said lands from about the year 1833 up to the fall of the
year 1844, that he claimed and managed the same as his own
by clearing and cultivating it, and by building houses and
making other improvements on it, and by frequent offers
to sell to divers persons,
The defendant then introduced and read to the Jury a [Patent? ]
from the General Government bearing date the 12th day of
September 1835 ~ to one Jefferson J Watts for the south
east quarter of the north east quarter of section 56 Township
18 Range 6 being a portion of the same lands, in controversy
and then introduced and read a deed from said John Scarborough
Conveying the whole of said lands to said Watts which deed is
in the words and figures following [to wit?] , and proved that said
deed was recorded in the proper office on the 26th day of July 1841
Know all men by these presents that I John Scarborrough of
the County of Perry and State of Alabama for and in the Consi-
deration of the sum of eleven hundred and sevent Dollars
dollars to me in hand paid by Jefferson J Watts of the county
and state aforesaid the receipt of which I do hereby acknowledge
have granted bargained sold and conveyed and by these
presents do grant bargain sell and convey with the said Jeffereys
erson. J Watts his heirs and assigns all that tract or parcel of land
Situated in the County and State afforesaid known and
distinguished as the South east fourth of the North east
fourth and the east half of the south east fourth all in
Township eighteen range six and Section thirty Six, east in
the district of land [al sect ?]to sale at Cahawba Alabama
together with all and singular the heriditaments and
appurtenances whereunto belongings to have and to hold
