This one-page document announces the appointment of E. W. McKinstry as Adjutant General of the State of California. Governor Peter H. Burnett reported this appointment to the legislature when it convened in January of 1851. On April 25, the legislature voted to elect McKinstry to the position. The People of the State of California.

To all to whom these presents shall come, Greeting:

Know Ye, that reposing special trust and confidence in the capacity, gallantry, integrity and industry of Elisha Williams McKinstry I Peter Hardeman Burnett, Governor of the State of California, in the name and by the authority of the People of said State, do by these presents appoint him the said Elisha Williams McKinstry Adjutant General of the State of California to fill the Vacancy occasioned the resignation of Theron R. Perlee, to hold the same until the meeting of the next Legislature.

In Witness whereof I have caused the Great Seal Of The State to be hereunto affixed

Given under my hand at the City of San Jose the Ninth day of December, in the year of our Lord Eighteen hundred and fifty, and of the Independence of the United States the Seventy fifth.
