of the M S Act 1854 - the real value of the Tallow - I replied
that the B of T would be satisfied by calling it £11 " 10. 0
They then doubled that amount - making it £25 " - . -
Divided by 5 as the portion of each }
man's offence -------------------- 4" 12 " -

They then determined that the "double value"
Penalty not exceeding £100 - " and "Costs" should
be made to amount to £6 - which was done
as follows - viz ----------------
Add Penalty not excdg £100 ------------------- -- " 10 " 10
"Costs" 17 . 2
-----------------
6 " 0 " 0
------------------
Consequently my having possession of the £5 in question
did not operate individually upon Danby. -- The effect
was spread over the whole case. -- And had Statters
paid the £11 " 10 " 0 to the men - instead of but £6.10 -
the Magistrates most likely would have convicted in
a larger Penalty than 10 s./10 d.
The convictions have had a very salutary
effect along the whole line of the Holderness coast
and I do not think it would be prudent to disturb
them. --- They appear to me to be strictly legal - and
the punishments are all tempered with moderation.
